• Terms and Conditions


    This Agreement sets out the complete Terms and Conditions (hereinafter called "these Terms and Conditions") which shall be applicable to all gaming services offered by Instabets (or “we/us/the Company” as hereinafter defined) and Instabets account opened by you (or “yours/customer as hereinafter defined) with the Company (as hereinafter defined). By using the Services, you agree to be bound by these terms and conditions, which incorporate the following additional terms (collectively, the "Terms"):

    These Terms & Conditions and any amendments or variations thereto take effect on their date of publication on the website and the continued use of your Instabets account and/or the Services constitutes your agreement to be bound by the terms of any such amendment or variation. It is your responsibility to check our site from time to time to review any updated Terms when published.

    The Terms shall also apply to all telephone betting and betting or gaming via mobile devices including downloadable applications to a mobile device (as if references to your use of the Website were references to your use of our telephone betting and/or mobile devices betting facilities).


    "Bet" means the staking of money on the prediction of the outcome of a sporting event.

    “Company” means Instabets.

    "Customer" means anyone placing a bet with the Company or any other services offered by the said company


    Before applying to open the Instabets account you should carefully read and understand these Terms and conditions which will govern the use and operation of the Instabets Account.

    You will be deemed to have read, understood and accepted these Terms and Conditions:

    upon clicking on the “Accept” option on the Instabets Menu requesting you to confirm that you have read, understood and agreed to abide with these Terms and Conditions; and/or

    by using or continuing to use and operate the Instabets Account and/or the Services.

    By applying to open the Instabets Account with the Company, you agree to comply with and be bound by these Terms and Conditions for the time being and from time to time in force governing the operation of the Instabets Account and you affirm that these Terms and Conditions herein are without prejudice to any right that the Company may have with respect to the Instabets Account in law or otherwise.

    By accepting Terms and Conditions, you are fully aware that there is a risk of losing money when gambling and you are fully responsible for any such loss. You agree that your use of our Service is at your sole option, discretion and risk. In relation to your losses you shall have no claims whatsoever against us or any of our partners, or respective directors, officers or employees.


    In order to open a Instabets Account with the Company, you must be at least 18 years old and are competent to enter into a binding legal agreement, and that you hereby understand and accept all the Terms.

    Our services are restricted to residents of jurisdictions where the use of our Service is not prohibited by law. All bets are void where prohibited by law.

    You may open a Instabets Account solely by way of an electronic application made by you using your Device and/or via the Company’s website www.instabets.co.ke 

    You hereby agree to provide your personal information including your phone number, name, date of birth, ID or Passport Number and such other information that will enable the Company to identify you and comply with the regulatory “Know Your Customer” requirements (together the “Personal Information”). You shall be required to update the Personal Information in case of any changes.

    Acceptance by the Company of your application for a Instabets Account shall be done via SMS sent to the Mobile Phone Number associated with your Account. The Company reserves the right to decline your application for a Instabets Account or to revoke the same at any stage at the Company’s sole discretion and without assigning any reason or giving any notice thereto.

    You hereby irrevocably authorize the Company to act on all Requests received by the Company from you (or purportedly from you) through the website and to hold you liable in respect thereof. The Company may nevertheless refuse to carry out any Requests if there are insufficient funds in your Instabets account.

    Users of the system should expect notifications in electronic form (app), SMS, email-the schedule of which the Company will determine.

    You may only register and operate a single account with a single mobile money wallet account. If you hold more than one account with the same mobile money service provider, we reserve the right to suspend duplicate accounts.

    You may not access the Service by means of another person's account. Should you attempt to open more than one account, under your own name or under any other name, or attempt to access the Service by means of another person's account, we reserve the right to immediately close all your accounts and bar you from future use of any of Service.

    The account registration process will use your mobile number as your username. You must keep this   information secret. Any actions carried out through your account will stand if your user name and password have been entered correctly.

    Should any customer give away, share or lose his/her account number and/or password, we will not be held liable for any claims that may result from, or regarding that account. Customers are solely responsible for their account transactions and should keep their account information strictly confidential.

    Employees of the Company, its licensees, distributors, wholesalers, subsidiaries, advertising, promotion or other agencies, media partners, retailers and members of the immediate families of each are not eligible to use the Service, and all accounts in violation of this clause will be immediately terminated.

    Your account will be considered dormant if it has not had any activity for 6 months. Account activity is defined as the following: making of a deposit or withdrawal; placement of a bet. The Company reserves the right to deduct a dormant account maintenance fee of up to Fifty Shillings (per month from an inactive account until such account is no longer in credit, has become active, or has been inactive for thirty months.

    You will not be allowed to transact on an inactive or dormant account but the Company shall, upon depositing money in to your account, inform you of the procedure to be followed to activate your inactive/dormant account


    The Company may debit your Instabets account for the transactions, costs and other charges in respect of the Company’s products and services provided to you. Accordingly, if you want to place bets or participate in gaming, you must deposit monies into your account.

    You should only deposit money into your account, for the purpose of you using such money to use the Company’s products and services on the Website. We shall be entitled to suspend or close your account if we reasonably consider or have reason to believe that you are depositing funds without any intention using the Company’s products and services. In such circumstances we may also report this to relevant authorities and you shall be liable for any and all claims incurred arising therefrom; and indemnify Instabets on demand for such claims.

    You should only deposit funds through the Company’s pay bill number. The business number 285673, account name, Instabets. We reserve the right to treat any deposits into the Instabets account as being invalid (and any winnings arising from such deposit as void).

    Any monies deposited with us will be held by our Mpesa bulk paybill account separately from our own accounts. Any monies held in your account shall not attract interest.

    You are solely responsible for any applicable taxes on transaction charges arising from the use of the Company’s services & products, any prizes and/or winnings that you collect from your use of the Service over and above taxes collected by us on your behalf. We will deduct applicable taxes from any prizes or winnings prior to payment to you; as a result, you acknowledge and agree that any amounts you receive shall be net of such deductions.

    You undertake that all money that you deposit in your account is untainted with any illegality and, in particular, does not originate from any illegal activity or source; and all payments made into your account are authorised and you will not attempt to reverse a payment made into your account or take any action which will cause such a payment to be reversed by a third party, in order to avoid any legitimate liability.

    You accept that all transactions may be checked to prevent money laundering and that any transactions made by you which Instabets deems suspicious, may be reported to the appropriate authorities.

    Winnings from settled bets are added to the balance of your betting account. Any funds/winnings credited to an account in error are not available for use, and Supabet reserves the right to void any transactions involving such funds and/or withdraw the relevant amount from your account and/or reverse the transaction, either at the time or retrospectively.

    All withdrawals will be processed to the payment account from which the deposits were made. There may be charges incurred for withdrawals.

    Withdrawal payments can only be made in the name of and to the registered account holder and Instabets will verify the identity of the customer before any withdrawal is completed.

    We reserve the right to undertake reasonable diligence to verify the validity of any bets, wagers or winnings as a precondition to paying out any wins or permitting player withdrawals.

    Withdrawals can be processed by clicking 'Withdraw' on the Website, subject to there being sufficient funds in your betting account.

    Instabets reserves the right to request a receipt showing proof of purchase of the voucher before any withdrawals are processed.

    Customers will only be able to withdraw their winnings subject to Mpesa terms and conditions. The remaining amount, if any, will be placed back in the customer’s account until such time that they are eligible for a further withdrawal. The Company may at its discretion pay the remaining amounts, if any, through RTGS/EFT to the Customer’s account.

    If we incur any charge-backs, reversals or other charges in respect of your account, we reserve the right to charge you for the relevant amounts incurred.

    We may, at any time, set off any positive balance on your account against any amounts owed by you to Instabets.

    The maximum winning amount for any bet is limited to Kenya Shillings one million (Kes. 1,000,000/-)

    Customers will only be able to withdraw their winnings subject to Mpesa terms and conditions. The remaining amount, if any, will be placed back in the customer’s account until such time that they are eligible for a further withdrawal. The Company may at its discretion pay the remaining amounts, if any, through RTGS/EFT to the Customer’s account.
